Owing to the global economic downturn, there has beenan effect on IP, as with just about everything else.Patentees are renewing fewer patents, and filing ingeneral fewer applications, trends which effect boththe Office and the profession of patent attorney. Onthe other hand, in bad times, contentious issues tend toincrease, so there may be more Oppositions, third partyobservations and the like. The Office and the professionare well placed to deal with any change of emphasisfrom filing to such issues. As they say in the theatreworld, the show must go on. In that regard, the fivelargest Patent Offices, the EPO, JPO, KIPO, SIPO andUSPTO (collectively IP5) are we understand makingprogress on what are known as Foundation Projects.These projects, for-example, a Common ApplicationFormat (CAFC), are ones which are common to allOffices. Once implemented, the CAFC could well have
implications for the profession. Nevertheless, bearing inmind backlogs, duplications and the perceived need forGrant of the „good“ patent, the work of IP5 is to bewelcomed. Is it the genesis of a World Patent – andwhere does WIPO figure?
On the EPO home front, we welcome Brian McGinleyas the new Vice-President of DG4for a period of 3 yearsfrom 1st July, 2009. Mr. McGinley has been with theOffice since 1977, is well-versed in its ways. There will bechallenges ahead, and we wish him every success inmeeting them.
Another „appointment“, so to speak, is the accessionof the Republic of San Marino to the EPC, as the 36th
Member State. With a population of about 31,000 SanMarino is Europe’s third smallest State. We warmlywelcome the newest Member State to the EPC.

Introduction
1. Stem cells/WARF (G2/06)The decision was, at the time of the meeting imminent(in fact it issued late November). The epi asked aboutsuitable disclaimers to deal with the issue; however, theEPO opined that examiners should not usually ask for adisclaimer, especially as it was not clear what mattershould be excluded.
No cases are being stayed of the EPO’s own motion inview of the WARF case, and indeed the general policynow is not to stay cases routinely. The EPO may, though,stay a case at the applicant’s request, if Article 53(a) EPCis the only issue remaining.
2. Essentially Biological Processes (G 2/07)This decision will take a while; it will be decided afterG2/06 and the diagnostics cases.
Lots of amicus briefs have been filed. Greenpeaceorganised a march to the EPO with cows and tractors.Political bodies also attended. They argued that the EPOshould only allow patents on GM plants, not ’natural’plants. There is a standard letter doing the rounds, manycopies of which were sent to EU politicians. It is now apolitical hot potato, and generating a lot of interest(which was unexpected). Amicus briefs from CIPA, epi
and seed companies had been filed (but were not alwaysin agreement, especially when dealing with the amountof human intervention).
RH mentioned that the winner of a recent Bavarianelection had used the slogan ’No genes in tomatoes’. (Ina survey, allegedly 80% of the public were against GMcrops). All agreed about the need for better education ofthe public, although this is not something the EPO caneasily do actively (for fear of being accused of bias).
3. Rule 71(3) procedureThe epi is still experiencing some examiners amendingthe description in the Rule 71(3) without the applicants’consent. Some examiners telephone first, which is to beencouraged. Whatever the mode of communication,attorneys would rather have a phone call or communi-cation first, before the changes are made. Often what anexaminer thinks is a ’minor’ change may not be. The epimentioned a case of an examiner making wholescaleamendments even when no amendments were explicitlyrequested. In general, examiners are requested by theepi only to make changes if the attorney has agreed tothem first. Examiners, though, say that it can take 2-3week for an attorney to get back to them on suggestedchanges. A faster response is usually received from in-house attorneys. RH said that if we have real problemswe can contact him.
BHJ remarked that examiners should only makeamendments on their own accord to correct typographi-cal errors. Examiners say that attorneys can delay inresponding; perhaps attorneys could tell the examiners ifthey are still awaiting instructions. The epi is to provideexamples of problems to the directors.
4. Non-Unity objectionsGLG considered that a very high proportion of cases lackunity. SJH said there had been no change in training; theonly change under EPC 2000 was that boards of appealdo not now decide on protests. RH commented thatboard of appeal case law forces the EPO to examine thefirst invention, so the EPO sticks to this rigidly (e.g. ifdisease states are listed alphabetically in a claim).
In the PCT the Rules now refer to the ’main’ invention,so examiners have a little more flexibility here. The episaid that examiners tend to take a formal, rather thancommon sense, approach. The EPO’s advice is to makesure you place the most important invention first.
5. Summons to Oral ProceedingsRH said the EPO were considering internal guidelines onthis issue (a checklist) but this was not yet in force. SW

complained about new objections being raised, but theEPO argued that this was acceptable if the amendmentsmade were not allowable (e.g. if they add matter). MFpointed out that some attorneys are happy to receivesummons to oral proceedings to show their clients thatthe EPO is getting serious.
The EPO’s practice is to consider (and give a decision)on all requests filed before the Rule 71a cut-off, evenwhen the client doesn’t attend, or withdraws his requestfor oral proceedings.
BI said that some parties request an interpreter inadvance, but at the oral proceedings didn’t need them.The interpreters are brought in from outside the EPO andcannot be cancelled late. Unnecessary interpreters costthe EPO about 460,000E in 2008. The EPO would ideallylike three weeks’s, but at least one week’s notice if aninterpreter will not be needed. The epi thought this wasnot unreasonable. In future, Formalities Officers maycontact parties in advance to check if interpreters arereally needed.
The epi suggested that examiners should not canceloral proceedings only a day or so before hearings, as thiswas very short notice. According to the EPO, examinersare encouraged to meet, and make a decision, well inadvance of the hearing date.
6. Rule 30 EPC 2000The epi said that some Formalities Officers are interpre-ting this rigidly, e.g. a small mistake in the listing, or notusing Latin. They are not using their discretion. The PCTprocedure seems to be more liberal and convenient. Theepi was encouraged to send directors a list of exampleswhere we have been asked to change/amend thesequence (and pay a fee) for only minor matters. Anexaminers’ group may look at practice in this area, in aworkshop, to see what is happening and how it isimplemented. Attorneys are encouraged to telephoneFormalities Officers about alleged defects.
7. Divisionals practiceThere will be new proposals from the EPO (since imple-mented). Abuse is seen as a filing divisional for exactlythe same subject matter as in the parent case.
8. Article 124 and requests for prior artSW said his firm had seen different approaches betweendifferent clusters. RH said biotech clusters were notkeen, and routinely do not ask for these documents.Certain technical areas may have CN, KR etc. documen-tation which cannot easily be translated (this is less likelyin biotech as most documents are in English). Examinersoften get prior art documents from the US Patent andTrademark Office anyway.
9. PPH (Patent Prosecution Highway)The EPO said that no PPH’s had yet been filed in thebiotech cluster. It was often better to use the PCT route;the only potential benefit is to get fast grant in Japan.
10. Fee Increases and Claims FeesThe reasons for increases in fees were discussed (IFRSaccounting standards, etc). The epi all agreed that thefee increases were unpopular, and possibly counter-pro-ductive. Applicants may even consider filing nationallyinstead.
11. Raising the Bar Initiative (and Proposed NewRules 62a, 70a, 137(4)EPC)
The epi was positive about Rule 63, and the idea of theExaminer contacting the attorney to obtain clarificationon what to search. All other proposals were generallyseen as being harsh and unpopular. The timelines forresponding to the EESR are unrealistically short. Theremay be problems over Rule 137 as the meaning of’clearly identify’ could be interpreted very restrictively.BI said this requirement will be checked by FormalitiesOfficers. This is only a first package of measures. Asecond round may include:

Summary of interesting cases of epi’s Disciplinary Committee

Two decisions of Chambers of epi’s Disciplinary Com-mittee have been delivered. It is proposed, that all epimembers take note:
In one decision it was made clear that the activities of acandidate that took place before they sat the EQE mightinfluence her/his ability to represent cases after she/heentered the list of professional representatives. In thiscase the candidate drafted a patent application for anapplicant, but when she/he later became a EuropeanPatent Attorney she/he represented an opponent againstthe later granted patent resulting from said application.This was found to be against the epi code of conduct.
In another decision, a Chamber of the DisciplinaryCommittee investigated the situation where, when filinga new Convention patent application, an independent
claim was restricted relative to the priority application.The Chamber found that the later claim was unnecess-arily narrowed in view of all the circumstances (it was notnecessitated by the prior art) and so was against theinterests of the applicant. This restriction was made by athen candidate for the EQE. The responsible EuropeanPatent Attorneys of the firm for which said candidateworked were reprimanded. In this decision the Chambermade it clear that, in its view, unnecessary restrictions toa claim may constitute an infringement of the code ofconduct, even if these restrictions were made by acandidate for the EQE, before later becoming an Attor-ney.
These decisions are open to Appeal.
epi Excess Liability Insurance 2009/2010
On 1 October 2009 the epi Excess Liability Insurancescheme will be renewed for a further year. It aims to givebetter insurance coverage at a reasonable price to epimembers.
The indemnity of basic professional liability insuranceschemes is often limited to EUR 1.022.584. Therefore,the epi Excess Liability Insurance scheme indemnifieslosses as far as they exceed EUR 1.022.584/equivalent.Its limit of indemnity is a further EUR 1.533.876 per lossso that – together with basic insurance – a total loss ofEUR 2.556.400 is covered.
There is a collective indemnity limit to EUR 15.338.756p.a. for all participating epi members which according toinsurance calculations will hardly be reached. The pre-mium for the epi Excess Liability Insurance scheme forthe insurance year 2009/2010 amounts to EUR 402,64plus legal insurance tax.

Online training tool for the EQE

Last year epi, EPO Academy and CEIPI decided to set up ajoint Working Group (WG) to develop online exercisesfor candidates preparing for the EQE. Aim of the projectis to provide new EQE-related exercises through theinternet which help EQE-candidates to self-test theirknowledge/competences with respect to the variousEQE papers.
Recently a first tangible result of the project has beenput online (www.eqe-online.org/questions/ orwww.eqe-online.org/forum/). It relates to paper DI andprovides some 70 questions on EPC time limits /deadli-nes. The format chosen allows a user to request (anumber of) open questions. After answering the ans-wers in turn by submitting the time limit and the legalbasis for it (EPC article/rule) the programme checks the
submitted answer and provides the calculation of thecorrect answer as well as the legal basis for it.
A pilot test with over 300 users has been completedsuccessfully.
We hope that this e-learning programme provides auseful addition to the arsenal of tools available to EQE-students. The WG welcomes feedback from users orother interested members.
Over time the Working Group will add questions onother aspects of EPC as well to the DI module.
The Working Group is currently developing a multiplechoice exercise relating to paper A (E/M) which is due togo online later this year. The Working Group will turn tothe other papers subsequently.

„Train the trainer“ EPC seminar

epi in cooperation with EPO Academy organised earlierthis year an extensive training for experienced nationalpatent attorneys from the ’newer’ member states on allaspects relating to the handling of EPC applications. Thepurpose of the 14-day training was to provide partici-pants with an in-depth knowledge and practical workingskills of EPC/PCT. The training was targeted at thoselocal, national patent attorneys who – after being trained– were willing to act as tutor at epi-seminars to beorganised after the training in their respective countries.Hence: the „train-the-trainer“ concept.
The programme started in March with 23 participantsfrom 9 countries. These participants were selected fromabout 35 candidates after passing an admittance test.
The programme consisted of the following modules:1. Fundamental aspects in patenting under the EPC (2
days)2. Formalities at the EPO (2 days)3. Claim drafting (2 days)4. Understanding Examiners’ communications and
Amendments (3 days)5. Opposition and appeal (2 days)6. Oral proceedings (3 days)
All modules (with the exception of number 2) werejointly tutored by an experienced EPO and epi tutor. Inthis way participants will be confronted in some caseswith allegedly different opinions. But the participants willalso have seen that these allegedly different opinions arein fact not that different: both „sides of a file“ i. e. theprofession and the EPO –will eventually – at least in mostcases – lead to a final version of a patent that can begranted.
From the side of epi the team of tutors consisted ofMessrs. Derek Jackson, Claude Quintelier, Francis Leyderand Paolo Rambelli. From the side of EPO most of thetutoring was performed by Mr. Daniel Thomas. Theevaluation forms completed by participants at the endof each session shows that the seminar and its tutorswere highly acclaimed.
On June 18, 2009 at the closing ceremony all 23candidates were presented their certificate signed by Mr.Claude Quintelier on behalf of epi and Mr W. van derEijk, Vice President EPO.
Now it is for the 23freshly trained trainers to distributethe newly gained knowledge amongst their fellow pat-ent professionals in their home countries. epi expects
that they start organising epi seminars in their respectivehome countries. (Actually the first seminar – in Lithuania– was already held in July less than 4 weeks after the endof the training).

The Standing Advisory Committee before the European Patent Office(SACEPO)

This year’s meeting of the SACEPO was the first of a newkind. Over the long history of the SACEPO, which wasinitiated by the first President of the Office, Mr. vanBenthem, membership of the Committee continued togrow. Whilst the participants in the very beginning werechosen as ad personam members (two per memberstate, one from industry and one from the private pro-fession) who expressed more or less their personalopinion, later on various bodies, such as the epi andBusiness Europe gained more influence over the partici-pants’ views and opinions (notably by remunerating theparticipating members for their travel expenses). Thus,the associations assumed responsibility for nominatingdelegates for the meetings, which normally take placeonce a year. With the growing number of member statesand double representation (industry/free profession) formost countries as well as the attendance of representa-tives from other professional organisations (such asinventors’ associations), the meetings became less flex-ible and more difficult to manage. Besides, some of thetopics discussed were of a very detailed and technical/legal nature and thus also time consuming.
The President of the Office, Ms. Brimelow thereforedecided to sharpen the profile of the SACEPO by reduc-ing the number of participants to 10 members each fromthe epi and Business Europe, and a small number of adpersonam members, notably from Academia. The ideabehind this change apparently also took account of thechanging role of patents, namely patents becoming partof a social contract and also public policy.
Ms. Brimelow chaired the meeting of the newlycomposed body herself for the first half day.
Instead of discussing more or less practical matters asin previous meetings, like amendments of Articles andRules, the new SACEPO’s discussion pertained to more
global matters, such as the interface between the patentsystem and public policy, in particular patents and stan-dards which sometimes tend to collide in their objectives.The EPO is particularly concerned with ICTstandards andthe transparency of patents in relevant technical fields,and noted that proposals circulate in WIPO to includestandards documentation in the PCT minimum require-ment. Nevertheless, members of the SACEPO ques-tioned the competence of the EPO in this particular field.
Another topic was green technology. The linkbetween IPs and environmentally sound technologies(EST) was dealt with in the European Patent Forum inLjubljana in 2008. The interest of the EPO is the pro-motion within the IP system of environmentally-friendlytechnology. Further topics of general interest were gov-ernance issues, such as the composition and workingmethods of the Administrative Council of the EuropeanPatent Organisation in view of the large number ofmember states, 36 at present (including the last twoaccessions – the Former Yugoslav Republic of Macedoniaand San Marino), the build up of confidence enhancingmeasures between the Offices of first filing and theOffices of second filing with an aim to avoid duplicationof work, the financing of the European Patent Office inthe future, and international cooperation with a view to„export“ the success story of the European Patentsystem. Of course, a topic turning up in every SACEPOmeeting was the work load of the Office, its backlog(with pending European examination proceduresamounting to more than 400.000 in 2008), and itsquality management.
All in all, the new composition of the SACEPO resultedin a livelier and more in depth discussion of subjectmatter then hitherto.

I. Einleitung
Die aktuellen Beschlüsse1 des Verwaltungsrats (VR) derEuropäischen Patentorganisation (EPO) vom 25. März2009 sind bei Anmeldern und zugelassenen Vertreternauf wenig Verständnis gestoßen. Diese Beschlüsse stel-len bereits die dritte Anpassung der Ausführungsord-nung (AO) zum Europäischen Patentübereinkommen(EPÜ) 2000 seit dessen Inkrafttreten am 13.12.2007 dar.Seit diesem Zeitpunkt gab es kein (Kalender-) Jahr ohne
Änderungen an der AO. Diese rasche Abfolge vonÄnderungen führt insbesondere im Hinblick auf die in2010 in Kraft tretenden Änderungen dazu, dass dasAusmaß und die Konsequenzen der Änderungen der AOund der Gebührenordnung durch die an den VerfahrenBeteiligten nur erschwert wahrgenommen werden kön-nen.
Die durchgeführten und geplanten Änderungen derAO stehen vordergründig im Zusammenhang mit derEPA-internen Initiative „Raising the Bar“2. Diese Initiativesoll das Ziel verfolgen, qualitativ hochstehende Patentezur Erteilung zu bringen. Liest man im Jahresbericht2008 des EPA weiter, ergibt sich aber ein anderes Bild.Durch die Änderungen soll eine „Steigerung der Ver-fahrenseffizienz“3 erreicht und verhindert werden, dassAnmelder „die Effizienz des Prüfungsverfahrens unter-minieren“4. Es geht also im Grundsatz darum, Gestal-tungsfreiheiten des Anmelders einzuschränken und ihnzu disziplinieren. Ob solche Einschränkungen zur Ver-besserung der materiellrechtlichen Qualität und Bestän-digkeit von Patenten beitragen, ist höchst zweifelhaft.
In diesem Aufsatz werden wesentliche Punkte undKonsequenzen der bisherigen und beschlossenen Ände-rungen an der AO zum EPÜ 2000 kritisch beleuchtet.
II. Gesetzgebung EPÜ 2000
1. RückblickMit dem Abschluss der Revisionskonferenz in Münchenvom 20. bis 29. November 2000 und der Publikation in2001 Sonderausgabe Nr. 4 ABl. EPA gemäss „Beschlußdes Verwaltungsrats vom 28. Juni 2001 zur Annahmeder Neufassung des Europäischen Patentübereinkom-mens“ war das EPÜ 2000 keineswegs abschliessendlegiferiert. Da im EPÜ 2000 vorgesehen war, dass eineVielzahl von materiellrechtlichen und verfahrensrecht-lichen Punkten neu in der AO geregelt werden sollten,nahm das EPÜ 2000für alle an der Ausarbeitung der AOnicht Beteiligten erst im Verlaufe des Jahres 2007 kon-kret Gestalt an. Am 13. Dezember 2007 trat das EPÜ2000 dann in Kraft.
2. Auswirkung von EPÜ Art. 33Die verstärkte Verschiebung von materiellrechtlichenund verfahrensrechtlichen Regelungen in die AO gibtdem VR der EPO verstärkt die Möglichkeit, Bestimmun-gen in der AO selbst zu implementieren (Art. 33(1)c).

Dem VR wurden somit weitreichende Kompetenzen beider Gestaltung der AO zum EPÜ 2000 eingeräumt. DieseKompetenzerweiterung erklärt sich aus praktischenÜberlegungen. Man wollte vermeiden, dass Änderun-gen von geringer Tragweite regelmäßig die Einberufungeiner diplomatischen Konferenz erfordern. Eine solcheumfassende gesetzgeberische Kompetenz birgt dieGefahr, dass das zuständige Gremium möglichst raschund in seinem Sinne Änderungen durchführt. Dies istbesonders problematisch, weil dem VR die demokrati-sche Legitimation fehlt: seine Mitglieder werden nichtvom Parlament des Mitgliedstaates gewählt, sondernvon der Exekutive ernannt. Ferner ist der VR eigentlichein Aufsichtsorgan, das für ordnungsgemäße Verhält-nisse sorgen soll. Anders ausgedrückt entsteht aus Ver-waltern, die von der Exekutive ausgewählt worden sind,unter Ausschluss der Öffentlichkeit ein Organ, dasgesetzgeberische Kompetenzen wahrnimmt und daskeiner Aufsicht untersteht. Das entspricht weder demGrundsatz der Gewaltenteilung, noch ist es mit dergerichtlichen Kontrolle der Verwaltung vereinbar.
3. Einseitiges GesetzgebungsverfahrenWeil auch der Gesetzesänderungen vorbereitende undberatende Ausschuss Patentrecht5 von VR-Mitgliedernund dem Präsidenten des EPA (unterstützt von EPA-Be-diensteten) als stimmberechtigte Personen gebildetwird, hat der VR bei Änderungen der AO freie Hand.Andere kompetente Teilnehmer im Ausschuss Patent-recht haben nur den Status von nicht stimmberechtigtenBeobachtern, wie beispielsweise das Institut der beimEuropäischen Patentamt zugelassenen Vertreter (epi).Werden Einwände seitens der Beobachter vorgebracht,können diese berücksichtigt werden, müssen aber nicht.In einer Abstimmung über Änderungen vertreten diestimmberechtigten Personen aber in der Regel die Inter-essen des VR bzw. der Amtsleitung. Diese Interessenlagewird dann dem VR zum Beschluss vorgelegt. KritischeMeinungen seitens der Anmelder bzw. zugelassenenVertreter haben also im Gesetzgebungsverfahren derEPO kein Gewicht, weil dieser Personenkreis weder imAusschuss Patentrecht noch im VR stimmberechtigt ist.Die Gesetzgebung erfolgt also einseitig durch den VR, inder Regel mit Unterstützung der Amtsleitung.
III. Würdigung der Änderungen per 1. April 2008
1. AnspruchsgebührenDie Änderung der R. 45 vom 6. März 2008 sowieweiterer darauf basierender Regeln musste aufgrundder Änderung der Gebührenordnung (beschlossen am14. Dezember 2007) vorgenommen werden. DieseÄnderung enthält die Einführung einer Anspruchs-gebühr von E 200.- ab dem 16. Anspruch bei gebühren-freien ersten 15 Ansprüchen.
Diese neue Gebührenstruktur erweist sich insbeson-dere für mittelständische und kleinere Unternehmen als
Nachteil, wenn in einer Schutzrechtsanmeldung meh-rere selbständige Ansprüche unterschiedlicher Katego-rien aufgestellt werden. In solchen Fällen reichen fünf-zehn Ansprüche in der Regel nicht aus, umbeispielsweise eine vollständige Beanspruchung sowohleiner Vorrichtung als auch eines Verfahrens samt bevor-zugter Weiterbildungen formulieren zu können.
Ferner wird abzuwarten sein, wie das EPA mit Patent-ansprüchen umgehen wird, in denen mehrere optionaleMerkmale aus früheren abhängigen Ansprüchen mit„und/oder“ bzw. „vorzugsweise“ und ähnlichen Ver-knüpfungen zusammengefasst werden, um die formaleAnzahl an Ansprüchen zu reduzieren. Innerhalb einesabhängigen Anspruchs sind dann mehrere Alternativeneinzeln enthalten.
Neben der inhaltlichen Kritik ist es auch hinsichtlichdes Zeitpunkts der Einführung dieser Änderungen unver-ständlich, warum diese Änderungen nicht gleich auf den13. Dezember 2007 eingeführt wurden.
IV. Würdigung der Änderungen per 1. April 2009
Die Hauptänderungen per 1.4.2009 betreffen eine ein-heitliche Benennungsgebühr und die Vorverlagerung derFälligkeit von Zusatzgebühren bei umfangreichenAnmeldungen. Zusätzlich zur nachfolgenden inhalt-lichen Kritik ist anzumerken, dass auch diese Änderun-gen bereits per 13. Dezember 2007 möglich gewesenwären mit vereinfachter Übergangsregelung, also ohneparallele Anwendung von zwei verschiedenen Regelnwie Regel 38, 39 und 71.
1. ZusatzgebührIn einer Gesamtsicht hinsichtlich des Bearbeitungsauf-wandes beim EPA ist die Vorverlagerung der Zusatz-gebühr (ab der 36. Seite der Anmeldung) im Sinne einerverursachergerechten Kostenzuweisung als Schritt in dierichtige Richtung zu werten. Die Grundlage der Seiten-zählung bezieht sich auf die eingereichte Fassung – sei esin irgendeiner Sprache oder in einer Amtssprache. DieSeitenzahl gemäss einer ggf. später eingereichten Über-setzung in eine Amtssprache ist unerheblich6.
2. Einheitliche BenennungsgebührDie Legitimation einer Benennungsgebühr ist durchArt. 79 gegeben. Die Einführung einer einheitlichenBenennungsgebühr ist für den Anmelder zwar eineVerfahrensvereinfachung, stellt aber für jene, die sichbisher zu Beginn des Verfahrens auf weniger als fünfbenannte Länder beschränkt haben, eine Verteuerungdes Verfahrens dar. Diese trifft ebenfalls Einzelanmelderbzw. kleine oder mittlere Betriebe als Anmelder amstärksten.
Sofern in Zukunft eine Anpassung des Art. 79 in einerdiplomatischen Konferenz in Betracht gezogen wird,wäre es wünschenswert, wenn die Benennungsgebüh-ren als gesonderte Einheitsgebühr komplett gestrichenwerden. Die Benennungsgebühr könnte ebensogut beider Einreichung der Anmeldung als Bestandteil der

Anmeldegebühr oder bei der Stellung des Prüfungs-antrages als Teil der Prüfungsgebühr erhoben werden.Dies wäre eine weitere Verfahrensvereinfachung für denAnmelder. Eine solche weitere Vereinfachung ist auchsinnvoll, weil für Art. 54(3) EPÜ 2000 durch Wegfall derR. 23a EPÜ 1973 die materiellrechtliche Bedeutung derEntrichtung von Benennungsgebühren sowieso ver-schwunden ist. Dies würde dann zu einer analogenRegelung bezüglich der Benennung von Ländern wiebeim PCT führen. Selbstverständlich müsste dabei aucheine eigenständige Regelung für Erstreckungsgebührenim Rahmen einer neuen Erstreckungsverordnung gefun-den werden. Eine solche Regelung müsste unabhängigvon der Benennung von Vertragsstaaten des EPÜ sein.
3. AnspruchsgebührenNebst der Einführung einer Anspruchsgebühr von E
200,- ab dem 16. Anspruch soll nicht unerwähnt blei-ben, dass die seit 1.4.2009 geltende Gebührenordnungweitere erhöhte Anspruchsgebühren (E 500,-) ab dem51. Anspruch vorsieht. Zusammenfassend ist zu dernunmehr geltenden mehrstufigen Erhebung vonAnspruchsgebühren anzumerken, dass sie speziell fürEinzelanmelder und mittelständische und kleinere Unter-nehmen anmelderfreundlicher hätte gestaltet werdenkönnen, z.B. mit tieferen Gebühren (deutlich < E 200,-)ab dem 11. Anspruch (ähnlich wie bis 31.03.2008) underhöhten Gebühren ab dem 30. Anspruch (> E 200,-).Dabei hätte das Amt ohne weiteres seine finanziellenInteressen wahren und gleichzeitig auf weniger finanz-starke Anmelder Rücksicht nehmen können.
Ob die neue Gebührenstruktur bei den Patentansprü-chen für das EPA vorteilhaft ist, wird sich noch zeigen.Finanziell stellen die 5 zusätzlichen gebührenfreienAnsprüche erst einmal einen Verlust für das EPA dar.Sollte sich dieser monetäre Verlust nicht durch die neuenAnspruchsgebühren ausgleichen lassen, ist wohl miterneuten, nicht anmelderfreundlichen Gebührenerhö-hungen an anderen Stellen zu rechnen.
V. Würdigung der Änderungen per 1. April 2010
Eine vollständige Information über die zukünftigenÄnderungen der AO per 1. April 2010 kann den ange-gebenen URL’s7 bzw. dem Amtsblatt8 entnommen wer-den.
Im Folgenden wird speziell eingegangen auf dieÄnderungen der Regeln 36(1), 36(2); 137(4); 161 sowieauf die Einführung der neuen Regel 70a.
1. Neues Verfahren bei TeilanmeldungenDas Instrument „Teilanmeldung“ ist durch die PariserVerbandsübereinkunft (PVÜ) Art. 4G(1) vorgegeben. Dadas EPÜ ein Sonderabkommen gemäss PVÜ Art. 19 ist,dürfen EPÜ-Bestimmungen der PVÜ nicht zuwider lau-fen.
Aus für Aussenstehende nicht nachvollziehbarenGründen wurde innerhalb des EPA über eine Verschär-fung des Verfahrens für Teilanmeldungen intensiv nach-gedacht. Im Dokument CA/PL 8/08 des AusschussesPatentrecht, Kapitel IV „Abuse of Divisionals“, wurdefestgehalten, dass eine Duplizierung des Prüfungsver-fahrens durch Einreichung von Teilanmeldungen einMissbrauch des Patentsystems durch die Anmelder sei.Um diesen Missbrauch einzudämmen, wurden zur Über-raschung der Anmelder und Vertreter die Regeln 36(1)und 36(2) am 25. März 2009 durch den VR-Beschlussgeändert, der am 1. April 2010 in Kraft treten wird.
Aus der Teilanmeldungen betreffenden EntscheidungG 0001/059 ist zum Thema „Missbräuche“ ausgeführt:
„Wenn administrative Maßnahmen wie eine Priori-sierung von Teilanmeldungen bei der Prüfung undeine Bündelung und schnelle Bearbeitung vongleichzeitig anhängigen Teilanmeldungen, die esden Anmeldern erschweren, Gegenstände, hin-sichtlich derer die Prüfungsabteilung in einerAnmeldung bereits eine negative Stellungnahmeabgegeben hatte, dadurch aufrechtzuerhalten,dass sie sie immer wieder von Neuem einreichen,so sollte der Gesetzgeber überlegen, worin Miss-bräuche liegen und wie für Abhilfe gesorgt werdenkann.
Ob ein Missbrauch bei der Einreichung einer Teilan-meldung vorliegt, ist also in hohem Masse ermessens-abhängig.
Die Duplizierung des Prüfungsverfahrens durch Ein-reichung von Teilanmeldungen als Missbrauch zu quali-fizieren (CA/PL 8/08), entbehrt jeglicher Grundlage. Fürdiese Duplikate entrichtet der Anmelder je eine Anmel-dungs- und Prüfungsgebühr sowie bereits aufgelaufeneJahresgebühren. Mindestens ökonomisch betrachteterleidet auch das EPA bei den Duplikaten keine Nach-teile. Im Gegenteil: die Bearbeitung einer mindestensteilweise schon bearbeiteten europäischen Anmeldungist einfacher.
Das Argument Missbrauch durch Duplizierung stütztdas EPA auf folgende Zahlen (Quelle CA/PL 8/08):– 5% aller europäischen Patentanmeldungen sind Tei-
lanmeldungen;– Teilanmeldungen der zweiten Generation machen
7% aller Teilanmeldungen aus; und– Teilanmeldungen der dritten oder weiteren Genera-
tion machen 1% aller Teilanmeldungen aus.
Unterstellt man, dass die Teilanmeldungen zweiter oderhöherer Generation alle auf „Missbräuchen“ beruhen,so kommt man aufgrund der Anmeldezahlen für 2007von rund 141.000 Anmeldungen auf eine Anzahl vonrund 550 „missbräuchlichen“ Anmeldungen. Vor die-sem Hintergrund stellt sich die Frage, ob nicht dienormale Bearbeitung der Teilanmeldungen zweiter undhöherer Generation (ca. 8% aller Teilanmeldungen bzw.4‰ (Promille!) aller Anmeldungen) für alle Beteiligten(Anmelder und deren Vertreter sowie Amt) den kleine-

ren Aufwand bedeutet als die Implementierung, Umset-zung und Überwachung der neuen 24-Monatsfrist. Diegewählte Regelung erscheint weder für das Amt nochfür die Anmelder vorteilhaft, sondern führt auf beidenSeiten zu einem unnötigen administrativen Aufwand.Der Anmelder wird zusätzlich in seinen Gestaltungs-möglichkeiten stark eingeschränkt. Findige Anmelderund Vertreter haben bereits Umgehungsmöglichkeitender 24-Monatsfrist in Umlauf gebracht, welche es auflegale Weise ermöglichen, auch eine Teilanmeldungnach Ablauf der 24 Monate in petto zu haben 10.
Es wird interessant sein, wie sich die Anzahl derTeilanmeldungen in den ersten 6 Monaten ab dem1.4.2010 aufgrund der im Verwaltungsratsbeschluss11
enthaltenen Übergangsregelung entwickeln wird. Es istzu erwarten, dass finanzstarke Anmelder mindestenseine Teilanmeldung auf Vorrat anlegen werden. Dieskönnte auch in Zukunft vor Ablauf der neuen 24-mona-tigen Frist eine Strategie ebendieser Anmelder sein. Dasolche Teilanmeldungen auf Vorrat nur für finanzstarkeAnmelder eine realistische Option darstellen dürften,stellt das neue Verfahren eine klare Benachteiligungvon mittelständischen Unternehmen und Einzelanmel-dern dar. Es ist weiter anzunehmen, dass die Zahl derTeilanmeldungen (auf Vorrat) steigen wird, was zu einerstarken Belastung des EPA führen wird. Diesbezüglichwird ein weiteres Mal auf den Jahresbericht 2008 ver-wiesen: Das Amt „erwartet, dass seine Ressourcen nichtfür grundsätzlich vermeidbare Verfahrensbelange ver-geudet werden“. Dies ist aber mit dem neuen Verfahrenbei den Teilanmeldungen gerade zu erwarten, weil derAnmelder im Zweifel mindestens eine Teilanmeldung aufVorrat einreichen wird, die – sofern sie später nicht mehrgebraucht wird – ein zu vermeidender, zusätzlicherVerfahrensschritt darstellt, der seine Ursache unmittelbarin der neuen Regelung hat.
Gemäß Übergangsregelung sind vom neuen Verfah-ren bei Teilanmeldungen auch alle noch anhängigenAnmeldungen betroffen. Es handelt sich hierbei um eineunechte Rückwirkung, bei der die Rechtsfolgen dergeänderten AO erst ab 1. April 2010 eintreten, wobeidie neue Regelung an gegenwärtigen, noch nicht abge-schlossenen Sachverhalten (anhängige Anmeldung)anknüpft mit Rechtsfolgen für die Zukunft an (Frist fürEinreichung einer Teilanmeldung), wodurch die betrof-fene in der Vergangenheit erworbene Rechtsposition(Teilanmeldung möglich solange Stammanmeldunganhängig) nachträglich entwertet wird. Bei einer Inter-essen- und Güterabwägung unter Berücksichtigung desVertrauensschutzes des Anmelders hätte die Übergangs-regelung dem Anmelder Vertrauensschutz zu gewähren,da sein schutzwürdiges Vertrauen auf den bisherigenRechtszustand überwiegt. Neben dieser rechtlichen Ein-schränkung wird Anmeldern und Vertretern durch dieÜbergangsregelung zusätzlich ein finanzieller Aufwandin zweistelliger Millionenhöhe (bei Annahme eines Über-prüfungsaufwandes von z.B. nur E 80.- pro anhängiger
Anmeldung) aufgebürdet, um die Fristenlage hinsicht-lich Teilanmeldungen in jeder anhängigen Anmeldungzu prüfen und entsprechende Schritte einzuleiten.
Zusammenfassend ist festzustellen, dass die ange-strebte Änderung beim Verfahren der Teilanmeldungeninsoweit mit den sehr allgemeinen Vorgaben der PVÜkonform sein mag, als Teilanmeldungen weiterhin mög-lich sind. Aber im Hinblick auf die Verfahrensökonomieund die Verfahrensführung wurde für den Anmeldereine wenig durchdachte und insbesondere keine „sinn-volle Regelung“ gefunden, wie dies vom EPA publiziertwurde12.
2. Zur Einführung der R. 70a und der Änderung vonR. 161
Die neue Regel 70a bezieht sich auf R. 70(1) und siehtvor, dass das Europäische Patentamt den Anmeldergegebenenfalls auffordert, Mängel in den Anmeldungs-unterlagen binnen einer Frist von 6 Monaten nachHinweis auf die Veröffentlichung des Recherchenbe-richts zu beseitigen. Die geänderte R. 161 sieht für einesolche Mängelbeseitigung eine Frist von 1 Monat vor.
Beide Regeln erwecken vordergründig den Anscheineiner gleichartigen Behandlung von EP-Direktanmeldun-gen und Euro-PCT-Anmeldungen. Die Änderungen die-ser Regeln haben aber bei genauerer Betrachtung eineganz unterschiedliche Qualität.
a) Zur neuen R. 70aAuch wenn durch das BEST-Programm (Bringing Exami-nation and Search Together) des EPA dieselbe Personeine Recherche zu einer Anmeldung durchführt, dieStellungnahme im Rahmen des erweiterten europäi-schen Recherchenberichts (EESR) erstellt und nach Vor-liegen des Prüfungsantrags die Prüfung durchführt, so istrechtssystematisch im EPÜ eine Trennung zwischenRecherchenabteilung (Art. 17) und Prüfungsabteilung(Art. 18) vorgegeben. Diese Trennung wurde bei dervorliegenden Einführung der R. 70a nicht berücksichtigt.In den Artikeln 92 und 94 EPÜ ist festgelegt, was imRahmen der Recherche bzw. Prüfung durch die formal-juristisch getrennten Abteilungen erledigt werden soll.
Nach Art. 94(3) fordert die Prüfungsabteilung denAnmelder auf, die Unterlagen zu ändern. Die in derneuen R. 70a vorgesehene Aufforderung erfolgt durchdie zu diesem Zeitpunkt des Verfahrens zuständigeRecherchenabteilung (im Wortlaut der R. 70a: „daseuropäische Patentamt“), was aber nicht zu deren inArt. 92 definierten Kompetenzen, nämlich „Erstellenund Veröffentlichen des Recherchenberichts“ gehört.Dass durch die R. 62 (EESR) eine Stellungnahme zumRecherchenbericht eingeführt wurde, kann der inArt. 92 vorgeschriebenen „Erstellung des Recherchen-berichts“ zugeordnet werden. Eine Aufforderung, Män-gel zu beseitigen und Unterlagen zu ändern, geht aberüber das in Art. 92 vorgesehene „Erstellen und Ver-öffentlichen des Recherchenberichts“ hinaus. Hier wer-den Kompetenzen, die nach Art. 94 eindeutig der Prü-fungsabteilung zugeordnet sind, auf die dafür nicht

zuständige Recherchenabteilung übertragen. DieAnmeldung ist zum Zeitpunkt der Herausgabe des EESRnoch nicht in der Zuständigkeit der Prüfungsabteilung.Diese Zuständigkeit der Prüfungsabteilung erfolgt erstmit der Stellung des Prüfungsantrags (R. 10(2)). Diedargelegte Vermischung von im EPÜ formaljuristisch klargetrennten Zuständigkeiten und Kompetenzen ist wohlunmittelbar auf die im Amt „gefühlte“ Einheit vonRecherche und Prüfung im Rahmen des BEST-Programmszurückzuführen. Eine solche Einheit ist aber im EPÜgesetzgeberisch nicht umgesetzt.
Vor dem Hintergrund, dass eine Aufforderung nach R.70a(1) von einer gemäß EPÜ dafür nicht vorgesehenenAbteilung herausgegeben wird, stellt sich somit auch dieFrage, ob die Rechtsfolgen gemäß R. 70a(3) überhauptWirkung entfalten können. Dies wird die künftige Recht-sprechung klären, wenn eine diesbezüglicheBeschwerde zu behandeln sein wird.
Die Aufforderung in R. 70a erfolgt in Zukunft zwangs-weise, wenn die Recherchenabteilung Mängel in denAnmeldungsunterlagen findet. Dies wurde im Jahres-bericht 200813 im Übrigen bereits entsprechend vor-angekündigt, in dem öffentlichkeitswirksam von einer„obligatorischen Erwiderung des Anmelders auf die demRecherchenbericht beiliegende Stellungnahme …“gesprochen wird.
Zur Einführung der R. 70a(1) ist außerdem festzustel-len, dass der Anmelder aufgrund seiner auf den Ergeb-nissen des EESR basierenden (ökonomischen) eigenenBewertung der Anmeldung eine Entscheidung trifft, ober die Anmeldung weiterführen will. Entsprechend wirdder Anmelder die Prüfungs- und Benennungsgebührentrichten. Entscheidet sich der Anmelder aber dafür,die Anmeldung nicht weiterzuführen, geht die Auffor-derung nach R. 70a ins Leere. Dies ist aus einer Innen-sicht des EPA genau das Gegenteil von „Steigerung derVerfahrenseffizienz“. Anscheinend ist die Sicht im EPAbezüglich der Verfahrenseffizienz aber nur darauf fokus-siert, dass der Anmelder dazu angehalten wird.
b) Zur geänderten R. 161Eine Mitteilung nach R. 161 wird nach alter und neuerAO erst erlassen, wenn der Anmelder die erforderlichenSchritte gemäß R. 159 zur Einleitung der regionalenPhase wirksam vorgenommen hat. Dies geschieht nor-malerweise unter voller Ausnutzung der Frist von 31Monaten (R. 159). In aller Regel ist mit dem Ablauf der31-Monatsfrist auch der Prüfungsantrag wirksam zustellen. Das wirksame Stellen des Prüfungsantragesbedeutet, dass die betreffende Euro-PCT-Anmeldung indie Zuständigkeit der Prüfungsabteilung übergegangenist (R. 10(2)).
Der von der ISA=EP oder der IPEA=EP erstellte schrift-liche Bescheid bzw. vorläufige Internationale Prüfungs-bericht ist qualitativ vergleichbar mit einem Bescheidnach Art. 94(3). Die Qualität dieser beiden in der inter-nationalen Phase entstehenden Dokumente/Bescheidewird hier ausdrücklich anerkannt.
Die vorgesehene Mitteilung nach der ab 1. April 2010gültigen R. 161 hat zwei Konsequenzen:i) Sie stellt im Regelfall (=Einleitung der regionalen
europäischen Phase nach 31 Monaten) den erstenBescheid dar, der von der Prüfungsabteilung erlassenworden ist. Das Datum dieses Bescheides löst folg-lich die neue 24-Monatsfrist für das Einreichen einerTeilanmeldung aus (neue R. 36(1), siehe obenKap. 5.1).
ii) Auf einen materiellen Prüfungsbescheid hat derAnmelder innerhalb der gesetzlichen Frist von 1Monat zu antworten. Für diese Frist kann keineFristverlängerung gemäß Regel 132(2) beantragtwerden, sondern gegebenenfalls nur die gebühren-pflichtige Weiterbehandlung. Demgegenüberbeträgt im eigentlichen Prüfungsverfahren die Fristzur Beantwortung in aller Regel 4 Monate mit derMöglichkeit, diese auf rechtzeitig gestellten Antraghin verlängern zu können.
Die vorstehend aufgeführten Konsequenzen ergebensich aus einer sachkundigen Interpretation der Gesamt-heit der Regelungen des EPÜ.
c) FazitDie Einführung der Regel 70a und die Änderung der R.161 im Hinblick auf die Aufforderung zur Änderung derUnterlagen durch die Recherchenabteilung erscheinenim Lichte der vorhergehenden Ausführungen wenigdurchdacht. Dies führt sogar dazu, dass in Bezug aufdie neue R. 70a die Frage im Raum steht, ob derVerwaltungsrat bei den Änderungen der Ausführungs-ordnung seine Kompetenzen überschritten hat, da die R.70a keine Weiterbildung bzw. Spezifizierung der zuge-hörigen Artikel 17 und 92 des EPÜ darstellt. Vielmehrwird in der AO eine im EPÜ so nicht vorgeseheneSonderkompetenz der Recherchenabteilung definiert,um die durch BEST amtsintern vorgesehene Einheit vonRecherchenabteilung und Prüfungsabteilung schlei-chend zum Gesetz zu machen. Eine derartige dem EPÜwidersprechende gesetzgeberische Umsetzung von imAmt gelebter Praxis in der AO ist nach gängigem Rechts-verständnis eigentlich nicht hinnehmbar. Leider gibt esaber keine juristische Möglichkeit, gegen Beschlüsse desVR vorzugehen bzw. Änderungen in der AO von einerunabhängigen Instanz überprüfen zu lassen.
Die neue Regel 70a und die geänderte R. 161 zwingenden Anmelder dazu, vor der Herausgabe eines eigentli-chen Prüfungsbescheids nach Art. 94(3) Stellung zubeziehen und Mängel in den Unterlagen zu einemfrüheren Zeitpunkt als bisher zu beseitigen. Es bleibtabzuwarten, wie das EPA Anmeldungen behandelnwird, bei denen der Anmelder/Vertreter nur eine kurzeStellungnahme als Reaktion auf die Mitteilung nach R.70a bzw. R. 161 abgibt, ohne Änderungen in denUnterlagen vorzunehmen. Nach R. 70a(3) sollte einesolche Stellungnahme ausreichen, um die Rücknahme-fiktion der R. 70a(3) zu vermeiden.
Die angeblich vom EPA angestrebte Effizienzsteige-rung beim Prüfungsverfahren kann nur dann erreicht

werden, wenn das Amt selbst auf rechtzeitig einge-reichte Änderungen bzw. Stellungnahmen innerhalbweniger Monate (<6 Monate) reagiert. Falls sich dasAmt mehr Zeit lassen wird, hätte man auch beim derzeitgeltenden Verfahren mit Prüfungsbescheid und verlän-gerbarer 4-Monatsfrist bleiben können. Seitens derAutoren wird bezweifelt, dass das EPA ausreichendKapazitäten zur Verfügung stellt, um die angestrebteEffizienzsteigerung auch amtsintern im gleichen Massedurchzuführen, wie dies das EPA vom Anmelder erwar-tet. Ob eine Effizienzsteigerung bei der amtsseitigenVerfahrensführung der Qualität der Prüfung zuträglichsein wird, bleibt abzuwarten.
3. Zu den Änderungen von R. 137Die Änderung der R. 137(2) ist die logische Konsequenzder neuen R. 70a und R. 161.
In R. 137(3) wurde gestrichen, dass der Anmeldernach Erhalt des ersten Bescheids der Prüfungsabteilungvon sich aus die Beschreibung, die Patentansprüche unddie Zeichnungen einmal ändern darf, sofern die Ände-rung gleichzeitig mit der Erwiderung auf den Bescheideingereicht wird. Nach der neuen R. 137(3) wird derPrüfungsabteilung die Möglichkeit eröffnet, dass demAnmelder keine Gelegenheit mehr zur Einreichung vonÄnderungen gegeben wird, wenn er auf eine Aufforde-rung nach R. 70a bzw. R. 161 nicht reagiert hat. DieseSituation kann eintreten, obwohl der Anmelder denPrüfungsantrag gestellt hat und obwohl ihm inArt. 94(3) zugesichert ist, dass die Prüfungsabteilungden Anmelder so oft wie erforderlich auffordert, Ände-rungen einzureichen. Es ist somit möglich, dass die fürdie Prüfung der Patentanmeldung eigentlich zuständigePrüfungsabteilung auf Grundlage der Stellungnahmezum europäischen Recherchenbericht bzw. auf Grund-lage des schriftlichen Bescheids der internationalenRecherchenbehörde bzw. des internationalen vorläu-figen Prüfungsberichts direkt eine Zurückweisung her-ausgibt, wenn sie keinen weiteren Änderungen mehrzustimmen möchte.
Das Erfüllen der Anforderungen gemäß neuer R.137(4) ist bereits jetzt eine Selbstverständlichkeit. Dasbestehende Instrumentarium reicht nach Auffassung derAutoren aus, um bei einem ungenügenden Nachweisder Offenbarung vorgenommener Änderungen denAnmelder in die Pflicht zu nehmen, vgl. RiLi E II 1. ImFalle des ungenügenden Nachweises von durchgeführ-ten Änderungen könnte nach geltendem Recht einBescheid nach Art. 94(3) mit einer Fristsetzung von 2Monaten herausgegeben werden. Die nun in der neuenR. 137(4) festgelegte und somit nicht verlängerbare Fristvon einem Monat ist sehr knapp bemessen, sodass es zuhäufigen für das EPA lukrativen Weiterbehandlungenkommen wird. Hinsichtlich der angestrebten „Verfah-renseffizienz“ ist der Zeitgewinn von maximal 1 Monatgegenüber einem Bescheid nach Art. 94(3) bezogen aufdie gesamte Verfahrensdauer vernachlässigbar. Wird dieWeiterbehandlungsfrist im Falle eines Verstoßes gegendie neue R. 137(4) seitens des Anmelders vollständigausgereizt, also 2 Monate nach Zugang einer entspre-
chenden Rechtsverlustmitteilung nach R. 112(1), ist voneiner Dauer bis zur Behebung des Mangels von minde-stens 4 Monaten auszugehen, da die Herausgabe derMitteilung nach R. 112(1) normalerweise auch einigeWochen in Anspruch nimmt. Es stellt sich somit dieFrage, ob es im Sinne der Verfahrensökonomie nichtbesser (gewesen) wäre, das bisherige Verfahren mit eineramtsseitigen Fristsetzung von 2 Monaten beizubehalten,die auf maximal 4 Monate verlängert werden kann. Diebestehenden Möglichkeiten sind für das EPA aber wohlzu anmelderfreundlich und führen in den wenigstensFällen zu Gebühreneinnahmen (Weiterbehandlungs-gebühr).
VI. Stabilität des EPÜ als Garant für Anmelder undEPA
Seit Einführung des EPÜ 2000 sind durch den Verwal-tungsrat in jedem folgenden Jahr – bis einschließlich2010 – Änderungen an der AO vorgenommen worden.Es stellt sich bei dieser Flut an Änderungen die Frage, obdas EPA die für deren Umsetzung intern anfallendenKosten, beispielsweise für Computersystemanpassun-gen, Veröffentlichung der Änderungen, Schulung derFormalsachbearbeiter und der Prüfer, Anpassung derPrüfungsrichtlinien, korrekt dem erwarteten Nutzenbzw. (Zeit-)Gewinn durch die angebliche Steigerungder Effizienz der Verfahrensführung gegenübergestellthat. Es ist zu befürchten, dass hier unter dem VorwandEffizienzsteigerung bzw. unter dem Eindruck des angeb-lichen Missbrauchs des Patentsystems durch die Anmel-der/Vertreter wenig durchdachte Änderungen imple-mentiert wurden bzw. werden. Man kann sich auchdes Eindrucks nicht erwehren, dass insbesondere beiden Änderungen, die in 2010 in Kraft treten sollen,Aktionismus seitens des EPA treibende Kraft war, ohnedass die verantwortlichen Gremien über die Konsequen-zen vollends im Klaren zu sein scheinen.
Nach Darstellung des EPA werden die aktuell bekann-ten Änderungen nicht die letzten gewesen sein. Viel-mehr sind bei der Amtsleitung bzw. beim Verwaltungsratnoch weitere Anpassungen der Ausführungsordnung inDiskussion, u.a. Bearbeitung von Hilfsanträgen, Erstel-lung eines Handbuchs der optimalen Praktiken14, Auf-forderung zur Einreichung von nationalen Recherchen,aufgeschobene Prüfung, um hier nur einige zu nennen.Es sei bereits hier angemerkt, dass es der Verfahrensef-fizienz nicht förderlich sein wird, wenn neben AO undPrüfungsrichtlinien noch ein weiteres rechtlich wohlnicht verbindliches Handbuch durch die an den Verfah-ren vor dem EPA Beteiligten berücksichtigt werden muss.
Zu Anfang des Artikels wurde darauf hingewiesen,dass die durch die Einführung des EPÜ 2000 verstärktbeim VR liegende gesetzgeberische Kompetenz auchgefährlich sein kann. Mit der derzeitigen Häufung vonÄnderungen an den Verfahren vor dem EPA bestätigt derVR diese Befürchtung. Speziell im Hinblick auf die jüng-sten Änderungen15 ist nicht nur eine rasche Implemen-

tierung vorgenommen worden, sondern auch eineImplementierung die primär dem Ansinnen des VR bzw.der Amtsleitung entspricht und Anmelderinteressenunberücksichtigt lässt.
Es ist bedauerlich, dass an einem an sich gut funk-tionierenden Gesamtsystem (EPÜ) Veränderungen inForm von Schnellschüssen vorgenommen werden, dieweder für das Amt noch für die Anmelder einen tatsäch-lichen Vorteil bringen. Dass zur Rechtfertigung dieserÄnderungen die Anmelderschaft unter einer Art Gene-ralverdacht des „Unterminierens der Effizienz des Prü-fungsverfahrens“16 steht, ist inakzeptabel und durch dieAmtsleitung bzw. den Verwaltungsrat in keiner Weisesubstantiiert. Die im Jahresbericht 2008 enthaltenenkritischen Aussagen über das angeblich missbräuchlicheVerhalten der Anmelder sind grundsätzlich nicht geeig-net, das Patentsystem zu fördern. Vielmehr werden hierseitens des EPA Argumentationshilfen für Patentgegnerpubliziert, was weder im Interesse des EPA noch indenjenigem der Anmelder und Vertreter ist.
Änderungen an der AO sollten sich in umsichtigerWeise grundsätzlich danach richten, dass sie für denGroßteil der Anmelder tragbar und sinnvoll sind. Ein vonAktionismus getriebenes, gesetzgeberisches Schießenmit Kanonen auf Spatzen zwecks Eindämmung vonnicht belegbaren Missbräuchen sollte von der Amts-leitung und dem Verwaltungsrat vermieden werden. Esbleibt zu hoffen, dass der VR nicht weitere derartigeÄnderungen der AO beschließt, sondern bei Gesetz-gebungsfragen mehr Umsicht und Zurückhaltung wal-
ten lässt. Eine solche Zurückhaltung ist insbesondere imLichte der fehlenden gerichtlichen Kontrolle von Ver-waltungsratsbeschlüssen dringend notwendig.
Für das Gesetzgebungsverfahren wäre es außerdemwünschenswert, wenn die Position der Anmelder bzw.Vertreter zumindest im beratenden Ausschuss Patent-recht gestärkt wird. Diesem von allen Änderungenbetroffenen Personenkreis sollte ein Stimmrecht einge-räumt werden. Diese Forderung, im Zusammenhang mitdem Vorschlag einer veränderten Zusammensetzung desVR, wurde jüngst auch vom ehemaligen Chef-Öko-nomen des EPA erhoben17.
Die Autoren befürchten durch die Änderungen der AOauf den 1. April 2010 und weiteren diffus in Aussichtgestellte Änderungen eine schleichende Destabilisierungdes in der Vergangenheit sehr erfolgreichen EPÜ bzw.EPA. Sie wollen mit diesem Aufsatz eine breitere Fach-öffentlichkeit aufrütteln und zur Diskussion anregen.

Ein Werk wie dieses war überfällig!
In ihrem Vorwort stellen die Autoren zutreffend fest,dass das Vergütungsrecht der Rechtsanwälte durch dasRVG (mit immerhin 61 Paragraphen und einem nichtminder ausführlichen begleitenden Vergütungsverzeich-nis) gesetzlich besonders kodifiziert und – wie noch zuergänzen wäre – wissenschaftlich durch diverse Literaturausgiebig erschlossen ist. Bereits der flüchtige Blick ineine durchschnittlich ausgestattete Gerichtsbibliothek
bringt sieben Kommentare zum RVG zutage, die vonteils beeindruckendem Umfang sind. In völligemGegensatz dazu führt die Patentanwaltsvergütung einregelrechtes Schattendasein. Sie ist nicht nur ohne spe-zialgesetzliche Regelung und unterliegt damit dem all-gemeinen Dienstvertragsrecht des BGB. Auch auf der„Kommentierungslandkarte“ ist die Vergütung desPatentanwalts ein praktisch unberührter Fleck. Dassdieses Szenario dank des vorliegend zu besprechendenWerkes glücklicherweise der Vergangenheit angehört,ist zwei erfahrenen Praktikern des gewerblichen Rechts-schutzes zu verdanken: Dr. Friedrich Albrecht, Vorsit-

Die Bearbeitung zeichnet sich dadurch aus, dass wirk-lich umfassend sowohl materiell- als auch verfahren-srechtliche Aspekte für sämtliche Bereiche des geistigenEigentums aufgearbeitet werden. Weitere Qualitäts-merkmale, die bereits an dieser Stelle hervorgehobengehören, sind die argumentativ klare Gedankenführung,die schnörkellose, größtmöglicher Verständlichkeitverschriebene Sprache und die gelungene Textgliede-rung mit sinnvoller Absatzbildung, hilfreichen Über-schriften und ausgezeichnetem Layout. Lange gesch-lossene Passagen werden auf diese Weise vermiedenund Gewähr für eine insgesamt übersichtliche Darstel-lung geboten. Schaubilder, Grafiken, eine ganze Reiheanschaulicher Fallbeispiele, die drucktechnisch auf denersten Blick auszumachen sind, und ein für eine Erstau-flage ausgesprochen reichhaltiges Sachregister tun dasIhrige, um die Lektüre zu erleichtern, Gelesenes zuerinnern und Gesuchtes schnell und unkompliziert auf-zufinden. Die sachliche Bearbeitungstiefe wird durch dievielfältigen, zum beachtlichen Teil sogar unveröffent-lichten Gerichtsentscheidungen unterstrichen. Erfreuli-cherweise wurde dabei Wert auf möglichst aktuelleJudikatur gelegt und der Nachweis bloß rechtsgeschich-tlich interessierender Rechtsprechung konsequent ver-mieden.
Was erwartet den Leser inhaltlich im Überblick?
Nach einigen einleitenden Bemerkungen in den Teilen 1und 2 (Seiten 1-10), die sich der Sache angemessen kurzhalten, wendet sich die Bearbeitung den beiden inhalt-lich wesentlichsten Kapiteln zu, auf die an späterer Stellenoch detaillierter einzugehen sein wird. Teil 3 (Seiten11-48) behandelt zunächst den aus dem Mandatsver-hältnis entspringenden Vergütungsanspruch, d.h.etwaige Honorarforderungen, die dem Patentanwaltfür seine anwaltliche Tätigkeit gegen den eigenen Auf-traggeber zustehen. Teil 4 (Seiten 49-200) befasst sich –logisch daran anschließend – mit der Kostenerstattung,d.h. der Frage, in welchem Umfang Vergütungsbeträge,die im Innenverhältnis zum Mandanten verdient wordensind, im Falle des Obsiegens in einem kontradiktorischenVerfahren beim unterlegenen Gegner liquidiert werdenkönnen. Teil 5 (Seiten 201-211) wirft einen abrundendenBlick auf die Verfahrens- und Prozesskostenhilfe. Teil 6(Seiten 213-378) hält zum Abschluss verschiedene Mus-tertexte (Seiten 215-243) sowie eine Sammlung aller fürdie Patentanwaltsvergütung einschließlich Kostenerstat-tung einschlägigen Normentexte (Seiten 245-378)bereit. Beide Hilfestellungen sind für die Praxis vonaußerordentlichem Nutzen. Hinsichtlich der – danken-swerterweise auch in elektronischer Form zum Down-load – vorgehaltenen 19 Formulare versteht sich diesohnehin von selbst; für den Gesetzesanhang (dessenWert sich dem Leser in manch anderem Werk nicht
wirklich erschließt) ergibt sich der Gewinn aus demUmstand, dass die in Betracht kommenden Vorschriftentatsächlich abgelegen und deswegen für den Benutzerselbst nicht immer leicht aufzufinden sind. Hinzukommt, dass die einzelnen Gesetzestexte nicht einfachin alphabetischer Reihenfolge abgedruckt sind, sonderneigens aufbereitet wurden. Thematisch geordnet (z. B.nach „Kostenvorschriften in Streitsachen vor den orden-tlichen Gerichten“, „Kostenvorschriften in adminis-trativen Verfahren“, „Vorschriften zur Verfahrens- undProzesskostenhilfe“) werden jeweils nur diejenigen Aus-züge der maßgeblichen Gesetze wiedergegeben, die fürden betreffenden Themenkreis von Relevanz sind. DieAnhänge haben von daher auch in ihrem üppigenUmfang von 165 Seiten ihre volle Berechtigung.
Worum geht es im Einzelnen?
Breiten Raum im Kommentierungsteil (Seiten 11-48)nimmt der Vergütungsanspruch des Patentanwalts ausdem Mandatsverhältnis zu seinem Auftraggeber ein.Detailliert erörtert werden u.a. verschiedene Möglich-keiten zur Vergütungsfestsetzung, nämlich die Heran-ziehung der PAGebO 1968 unter Anwendung vonTeuerungszuschlägen, die Orientierung an Kammeremp-fehlungen oder an den Regelungen des für Rechtsan-wälte geltenden RVG sowie die Bedingungen undrechtlichen Grenzen ausdrücklicher Vergütungsverein-barungen. Im Anschluss daran kommen formelleThemen zur Sprache. Abgehandelt werden die Anfor-derungen an eine gerichtsfeste Gebührenabrechnungund deren Durchsetzung im Wege der Honorarklageoder der vereinfachten Kostenfestsetzung. Zur Unter-stützung stehen dem Leser im Anhang jeweils gut auf-bereitete Mustertexte zur Verfügung.
Den zweiten noch deutlicheren Schwerpunkt (Seiten49-200) bildet die Streitkostenerstattung. Sie wird get-rennt für Verfahren vor den Verletzungsgerichten, fürzweiseitige administrative Schutzrechtsverfahren undfür Verfahren vor dem HABM bzw. dem EPA dargestellt,wobei jeweils einer beeindruckenden Vielzahl von Ein-zelfragen nachgegangen wird. Nachstehend sind einigewenige, völlig willkürlich herausgegriffene Stichworteaufgelistet, die die außerordentliche Reichweite derKommentierung verdeutlichen: Streitwert, Abmahnung,Notwendigkeitsprüfung, Berufungsverfahren, Verkehrs-anwalt, einstweiliger Rechtsschutz, Zwangsvollstreck-ungsverfahren, Patentanwalt in eigener Sache, Kosten-festsetzung, Löschungsverfahren, Doppelqualifikation,Recherchekosten, Übersetzungen, Testkauf, Privatgu-tachten.
Gerade mit Rücksicht auf den zuletzt angesprochenenErläuterungsteil wäre es ein Trugschluss zu glauben, dassdas Werk nur für Patentanwälte hilfreich sein kann. Es istweit darüber hinaus jedermann ans Herz zu legen, dersich im Bereich des geistigen Eigentums mit Fragen derAnwaltsvergütung oder der vorgerichtlichen, gerich-tlichen oder behördlichen Kostenerstattung zu befassenhat.
